Insurance broking in Spain

Spain distinguishes the corredor de seguros, an independent broker acting for the client, from the agente exclusivo or vinculado tied to one or several insurers, and from bancassurance operators, which dominate life and mortgage-linked cover. The large insurers (Mapfre, Mutua Madrileña, Allianz, AXA, Generali, Catalana Occidente, Santalucía) rely on dense agent networks, while corredurías have won commercial business, fleets, residents' associations (comunidades de propietarios) and private clients who want a named contact.

The profession is organised in provincial Colegios de Mediadores de Seguros under a Consejo General, and the larger brokerages meet in ADECOSE. UNESPA represents insurers. Firms use brokerage management software and multi-insurer rating tools to compare carriers; the market has many corredurías of 3 to 30 staff, often family-owned, in every town.

Two Spanish particularities stand out: funeral insurance (seguro de decesos), one of the most widely held policies in the country and usually serviced by a local agent; and the weight of comunidades de propietarios, where each building is a multi-risk policy to renew with a property manager (administrador de fincas) as counterpart.

Compliance: what a brokerage must respect

A corredor must be entered in the DGSFP administrative register of distributors under Book II of Royal Decree-Law 3/2020, which transposed the IDD: good repute, initial and continuing training under Order ECM/1501/2024, professional indemnity, financial capacity, objective analysis of a sufficient number of contracts, pre-contractual information and a duty to advise. Operating without registration is a very serious offence. The Colegios enforce professional ethics among their members.

Personal data falls under the GDPR and Organic Law 3/2018 (LOPDGDD), supervised by the AEPD, one of the most active enforcers in Europe. Article 21 of the LSSI prohibits electronic commercial communications without prior consent, except to existing clients for similar products, with an opt-out offered in every message. WhatsApp falls within that rule; messages managing an existing policy (premium receipt, claim, renewal) are outside marketing.

For the firm that means a business number, an opt-in recorded on every client record, a clear privacy notice and a retained history: the DGSFP may check what information the client received, and the AEPD may ask for the legal basis of a message. A personal phone answers neither request.

WhatsApp in brokers' daily practice

In Spain WhatsApp is the default communication channel for individuals and businesses alike, and corredurías have used it for years: sending the claim form (parte) with photos, receiving the registration document and licence for a motor quote, chasing a bounced premium receipt, answering the residents' association president after a water leak. Many firms run a brokerage number on the free WhatsApp Business app, or several numbers, one per employee.

The first trap is the recibo devuelto: Spanish premiums are collected by domiciliación bancaria, often by the insurer, and a rejected direct debit can lead to cover being suspended. The broker must warn quickly, without collection-style wording, and point to the re-presented debit or payment to the insurer. The second trap is language: in Catalonia, the Basque Country or Galicia, part of the client base expects messages in its own language. The third is tempo: Spanish clients write late in the evening and expect a fast reply, which forces the firm to manage the 24-hour window and sending hours.

Corredurías that do well on WhatsApp have one number, short messages, the right register (tú or usted) per client, and move every document into the client file.

Frequently asked questions

Can a DGSFP-registered corredor send promotions on WhatsApp?

Yes, if the client gave prior consent or is already a client for a similar product, as Article 21 of the LSSI allows, with an opt-out offered in each message. Messages managing an existing policy are not affected.

How do you warn a client about a bounced premium receipt without sounding like debt collection?

With a factual service message stating the policy, the rejection date, the possible consequence for cover and the steps to take with the insurer. No threats, and always from the brokerage number.

Are templates in Catalan or Basque required?

Not a legal obligation for a corredor, but a sound commercial choice in the territories concerned. Each template is submitted to Meta per language, and the language on the client record drives segmentation.
