Insurance broking in Italy

Italian distribution is historically dominated by agenti, registered in section A of the RUI and tied to one or several insurers (Generali, UnipolSai, Allianz, Cattolica, Reale Mutua, Zurich), with an agency in almost every town. The broker, in section B, has established itself with companies, professionals, public bodies and complex programmes; bancassurance and Poste Italiane (section D) dominate life. Collaboratori (section E) work on behalf of an agent or a broker.

Brokers are represented by AIBA, agents by SNA and UNAPASS, and insurers by ANIA. The market is shaped by the weight of compulsory motor liability, by low penetration of non-motor property cover, and by the new obligation for businesses to insure against natural catastrophes, which triggered a wave of quote requests to brokers.

The typical firm is a broker with 3 to 30 staff, often in the North, with a book of companies, professionals and their families. The local agent, by contrast, receives clients at the agency and often collects premiums at the counter.

Compliance: what a brokerage must respect

Every intermediary must be entered in the Registro Unico degli Intermediari (RUI) kept by IVASS, in the relevant section, with professional indemnity cover, initial training and 30 hours of professional updating per year. The Private Insurance Code, amended by Legislative Decree 68/2018 to transpose the IDD, and IVASS Regulation 40/2018 set the distribution rules: pre-contractual information (annexes 3 and 4), suitability, conflicts of interest, record retention, distance communication and durable medium with the client's agreement.

Personal data falls under the GDPR and the Privacy Code, supervised by the Garante, which has issued decisions on messaging-based marketing and requires a specific consent, separate from the contract consent, for commercial communications; service messages about an existing policy rest on performance of the contract.

For WhatsApp, Regulation 40 provides the frame: exchanges on a durable medium are possible if the client has agreed and the intermediary can retain and produce them. The number must belong to the firm, the history must be exportable, and formal documents still go by email or certified PEC email when proof of receipt is needed.

WhatsApp in brokers' daily practice

WhatsApp is the universal messenger in Italy, and agents and brokers already use it heavily: a photo of the CAI accident form, the vehicle document sent for a motor liability quote, a renewal reminder with the amount, a certificate requested for a building site. Italian clients expect near-constant availability from their intermediary and prefer a voice note or written message to an email, which they reserve for documents.

The first trap is the boundary between an informal message and regulatory documentation: a quote sent on WhatsApp must be followed by the documents Regulation 40 requires. The second is collection: many agents still collect premiums at the counter or by POS, and a payment reminder must state clearly the accepted methods (SDD, bank transfer, card) and the deadline, especially for motor liability, where a late payment leaves the vehicle uninsured once the statutory grace period ends. The third is PEC: some formal communications require certified email or registered post, and WhatsApp does not replace them.

The calendar matters too: motor liability renewals are spread across the year, but commercial renewals cluster on 31 December, and brokers who start reminders in October avoid the year-end crush.

What ORIS changes for a brokerage in Italy

Frequently asked questions

Can a RUI-registered intermediary send a quote over WhatsApp?

Yes, as a preliminary exchange, provided the pre-contractual documentation required by IVASS Regulation 40/2018 follows and the exchange is retained. WhatsApp on a firm number with an exportable history allows that retention.

What consent is needed for a commercial WhatsApp campaign in Italy?

A specific marketing consent, separate from the contract consent, compliant with the Privacy Code and the Garante's guidance, revocable at any time. Renewal and claims reminders are service messages.

Can WhatsApp replace PEC for formal communications?

No. Certified email (PEC) and registered post keep their proof-of-receipt value where required. WhatsApp serves everyday exchanges, reminders and documents, not formal notifications.

Is ORIS also meant for section A agents?

Yes. An agency with several staff has the same need for a single number, a shared inbox and renewal campaigns as a broker. The regulatory frame applied remains the RUI and Regulation 40.
