Portugal distinguishes three categories of distributor under Law 7/2019: the agente de seguros, tied to one or several insurers, the corretor de seguros, an independent broker acting for the client, and the ancillary intermediary. Agents are by far the most numerous, with thousands of small neighbourhood agencies; corretoras are fewer and concentrate on companies, fleets and workers' compensation programmes. Bancassurance dominates life and mortgage-linked cover.
The leading insurers (Fidelidade, Ageas Portugal, Allianz, Tranquilidade/Generali, Zurich) maintain extensive agent networks. APROSE represents agents and brokers, APS the insurers. Firms run on intermediary management software and per-insurer portals; the typical firm has 2 to 15 staff, is often family-run and serves households, shopkeepers and local SMEs.
Two features shape the market: workers' compensation insurance (acidentes de trabalho), compulsory for every employer and for the self-employed, which makes every business a recurring client; and the use of Multibanco references and MB WAY to pay, which has created payment habits quite different from the rest of Europe.
Every distributor must be entered in the ASF register in its category, with professional qualification, good repute, professional indemnity and continuing training, under Law 7/2019, which transposed the IDD: pre-contractual information, duty to advise, remuneration transparency, conflicts of interest and document retention. The ASF issues regulatory standards, carries out inspections and keeps a public register clients can consult.
Personal data falls under the GDPR and Law 58/2019, supervised by the CNPD. Electronic commercial communications require prior consent under the e-commerce law (Decree-Law 7/2004), except to existing clients for similar products, with an opt-out in every message. Messages managing an existing policy are outside that rule.
A Portuguese firm must therefore be able to show, for each number, the consent obtained, the privacy notice and the history of exchanges; documents received on WhatsApp (driving licence, vehicle document, certificates) should be moved to the file and removed from the thread. A firm number on the WhatsApp Business API, logged and exportable, meets those conditions; personal phones do not.
WhatsApp is the dominant messenger in Portugal across all generations, and the relationship with the agent or broker has largely moved to that channel already: photos of damage after an accident, the green card sent across, the premium receipt requested for the accounts, a renewal reminder with the Multibanco reference. Many agencies display a WhatsApp number in their shop window.
The first trap is payment: premiums are paid by direct debit, Multibanco reference or MB WAY, often straight to the insurer, and a reminder must carry the right reference or point to the insurer's portal, never ask for a transfer to the firm. The second is documentation: the ASF expects pre-contractual information to have been delivered, and a WhatsApp exchange does not replace it. The third is seasonality: motor renewals spread across the year, but workers' compensation policies often renew on 1 January with updated payroll, and firms that request the payroll statement in November avoid the rush.
Portuguese clients appreciate a polite message, using senhor or senhora for business contacts, kept short, with the insurer's name and policy number, and a quick reply.
