Insurance broking in Mauritius

Mauritius is, with South Africa, one of the most insured markets on the continent: the Bank of Mauritius put penetration at 4.3% of GDP in 2024. Some twenty licensed insurers, the top three groups holding close to three quarters of assets, are represented by the Insurers' Association of Mauritius, founded in 1972. The island is also an international centre for captives and reinsurance.

Distribution combines tied agents (strong in life and motor), bancassurance, direct sales and brokers, licensed by the Financial Services Commission (FSC) in the categories insurance broker, insurance agent, insurance manager, insurance salesperson and claims professional. Brokers dominate corporate risks, group medical, private pension schemes, marine and professional indemnity; individuals mostly buy compulsory third-party motor, medical and life.

Port Louis, Ebène and Quatre Bornes concentrate the brokerages. English is the legal language, French the language of commerce and many policy wordings, and Mauritian Creole the language of conversation: a broker moves between the three in a single day. No brokers' association could be verified; firms deal directly with the FSC.

Compliance: what a brokerage must respect

The Insurance Act 2005, in force since 2007, and the Financial Services Act 2007 underpin the FSC licence for intermediaries; the FSC sets conditions per category, including the duty for brokers to keep a separate bank account for premiums collected, and publishes rules on returns and conduct. The Private Pension Schemes Act 2012 governs the pension plans brokers advise on. Anti-money-laundering requirements are strict, Mauritius having strengthened its framework after leaving international watch lists.

The Data Protection Act 2017, modelled on the GDPR, is enforced by the Data Protection Office (DPO): registration of controllers and processors, lawful basis, consent for direct marketing, data-subject rights, breach notification and controls on transfers abroad. A brokerage archiving WhatsApp conversations and client documents must register and keep its record of processing.

For WhatsApp: recorded opt-in, contract-based service messages, immediate withdrawal, limited retention and archiving in a brokerage system the FSC or the DPO can inspect. WhatsApp in brokers' daily practice

In Mauritius WhatsApp complements an already digital service: clients send photos and the accident report for a motor claim, ask for a green card before travelling, check their medical cover before a hospital stay, or confirm a fleet renewal. Messages are in French or Creole with individuals and in English with international companies and captives.

Recurring premiums are paid by direct debit or standing order; one-off payments go through MCB Juice, my.t money or Emtel's Blink, which are interoperable, as well as bank transfer and card. MCB Juice specifically supports insurance bill payments and recurring payments. The reminder must give the reference to enter and the amount in rupees.

Local traps: trilingualism that forces a template language choice per client, diaspora or expatriate clients paying from abroad, motor renewals tied to the road tax, and advisers managing clients from a personal number.
