Insurance broking in Poland

Poland draws a clear line between two trades. The broker ubezpieczeniowy, holding a KNF licence, acts for the client and has won companies, public bodies, fleets and group insurance programmes; brokers are represented by the Polish Association of Insurance and Reinsurance Brokers. Households mostly buy through agents: exclusive agents of the big insurers (PZU, Warta, Ergo Hestia, Allianz, Generali, Uniqa) and above all multiagencje, multi-carrier agencies selling motor and home cover in every town, represented among others by PIPUiF. PIU is the insurers' chamber.

The market is driven by OC komunikacyjne, compulsory motor liability, a heavily price-compared entry product; own-damage cover, home, personal accident and employer group life complete the book. Farm insurance (farmers' liability and buildings) is compulsory and significant in rural regions.

On the retail side the typical firm is a multiagencja of 2 to 15 people working on insurer portals and professional comparison tools; on the commercial side a broker of 5 to 50 people with renewals clustered at year end.

Compliance: what a brokerage must respect

The Act of 15 December 2017 on Insurance Distribution transposed the IDD. A broker must obtain a KNF licence after an examination and be entered in the rejestr pośredników ubezpieczeniowych (the KNF-kept register of agents and register of brokers); an agent is registered by the insurer that appoints it, and every individual who distributes must complete initial training and 15 hours of annual training. The Act requires a needs analysis, pre-contractual information, remuneration transparency and document retention; the KNF publishes recommendations brokers follow closely.

Personal data falls under the GDPR (RODO) and the Act of 10 May 2018, supervised by the President of UODO, who has imposed notable fines on insurers and intermediaries. Electronic direct marketing requires prior consent, now governed by the Electronic Communications Law (Prawo komunikacji elektronicznej) in force since late 2024; WhatsApp is covered, messages managing an existing policy are not.

For a Polish firm that means a business number, a marketing consent recorded separately from the contract, a privacy notice in Polish and a retained, exportable history. Insurance secrecy (tajemnica ubezpieczeniowa) adds a further layer for policy and claims data.

WhatsApp in brokers' daily practice

Honesty first: in Poland WhatsApp is not the dominant messenger. Messenger remains the most used, SMS is still widespread for renewal reminders, and WhatsApp is growing mainly among professionals, businesses and clients with ties abroad. A firm rolling out WhatsApp gains a structured channel for its commercial clients and for the clients who already use it, not a universal channel overnight.

Existing uses are nonetheless concrete: photos and the vehicle registration document sent for a motor quote, a reminder of the OC renewal date (where a single day without cover exposes the owner to a UFG penalty), the policy PDF forwarded, a claim followed up. Premiums are paid by bank transfer, BLIK or card, usually in one or two instalments; direct debit is a minority practice, which makes pre-renewal reminders particularly useful.

The pitfalls: sending a commercial message without explicit consent; confusing the OC renewal reminder, which is a service, with a renewal offer, which is marketing; and forgetting that clients often expect an email or SMS confirmation alongside the WhatsApp message.

Can a KNF-licensed broker send offers on WhatsApp?

Only with prior consent to electronic direct marketing, separate from the contract and recorded. Renewal reminders and claims-related messages are service messages.

Does the KNF register also cover agents working in multi-agencies?

Yes. Every agent and every individual who distributes must appear in the register of agents, entered by the appointing insurer, with the required training. The register is public and searchable online.
